Welcome to Forward Path (“Company,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our website, applications, maps, data visualizations, and related content (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Accounts and Subscriptions

Eligibility: Use of the Services is limited to authorized individuals acting on behalf of a subscribing organization or as individual subscribers. You represent that you are authorized to bind your organization to these Terms.
Account Registration: Each user must have their own unique login credentials. Accounts and credentials may not be shared among multiple individuals.
Subscription Tiers: We offer free and paid subscription plans. All fees are due in advance and are non-refundable except where required by law.
Renewal and Cancellation: Subscriptions automatically renew unless canceled before the end of the current billing period. Cancellation takes effect at the end of the current term.

2. License and Permitted Use

Non-Commerical Use: We may offer certain plans or access tiers designated as “Non-Commercial Use”. These tiers are intended solely for personal, educational, or research. Use of any Non-Commercial plan for business, government, or consulting purposes—including internal analysis, client reporting, regulatory filings, commercial research, or any activity undertaken on behalf of a company, nonprofit, or public agency—is strictly prohibited.
Limited License: Forward Path grants you on behalf of your organization a limited, non-exclusive, non-transferable, revocable license to access and use the Services for internal analytical purposes only.
Organizational Sharing Restrictions: Except as expressly permitted in writing by Forward Path:
- Data, maps, or screenshots may not be shared, distributed, or displayed to individuals who are not licensed users.
- You may not include screenshots or reproductions in internal reports, shared drives, or collaboration tools (e.g., Teams, Slack, SharePoint, PowerPoint, etc.) unless each viewer is a licensed user.
Prohibited Uses: You agree not to copy, download, reverse engineer, or use the Services to compete with Forward Path.
Alternate Licensing: Alternate licesning is available for those organizations who wish to share this data more fully within their organizaion without licensing the full organization. Please contact Forward Path at the email address listed at the end of this document to inquire.

3. Intellectual Property

The Services, including the website, user interface, software, visualizations, analytical methods, and design elements, are the exclusive property of Forward Path and its licensors, and are protected by copyright, trademark, and other intellectual property laws.

Certain underlying spectrum data displayed within the Services is derived from open data published by the United States Federal Government, including but not limited to datasets released by the Federal Communications Commission (FCC) and other federal agencies. Such source data is provided under public domain status or open government data licenses.

Forward Path's value-added processing, integration, enhancement, and presentation of that open-source data — including but not limited to its normalization, aggregation, enrichment, visualization, indexing, and analytical modeling — are proprietary works owned by Forward Path.

You acknowledge that, while the underlying government data may be publicly available, the organization, structure, formatting, metadata, analytical layers, and any derived datasets or visualizations produced by Forward Path are subject to copyright and trade secret protection.

4. Data Accuracy and Availability

The Data and maps are provided “as is” and may contain inaccuracies or omissions. We may modify or suspend access at any time.

Certain parts of the underlying Data are sourced from U.S. Federal Government datasets (e.g., FCC ULS data). Updates to this data may be delayed or temporarily unavailable during periods when the United States federal government ceases operations, such as during a government shutdown.

5. Confidentiality

All Data and related materials are confidential and proprietary to Forward Path. You agree to maintain them in strict confidence and prevent unauthorized disclosure.

6. Disclaimer of Warranties

The Services and Data are provided “as is” without any warranty, express or implied.

7. Limitation of Liability

Forward Path is not liable for any indirect or consequential damages. Our total liability shall not exceed the total fees paid by you in the twelve (12) months preceding the event giving rise to the claim.

8. Termination

We reserve the right to suspend or terminate your access if you violate these Terms or the Acceptable Use Policy below. Upon termination, all licenses cease, and you must delete any derived materials.

We reserve the right to suspend or terminate access to any account found to be using "Non-Commercial Use" plans for purposes inconsistent with the restrictions listed above.

9. Governing Law and Venue

These Terms are governed by the laws of the State of Nevada. Disputes shall be resolved exclusively in Clark County, Nevada.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services constitutes acceptance of any updates.

Acceptable Use Policy

This Acceptable Use Policy (“Policy”) governs your use of the Forward Path website, subscription services, spectrum maps, data visualizations, and related materials (collectively, the “Services”).

This Policy is incorporated by reference into the Terms and Conditions and applies to all subscribers, users, and organizations accessing the Services (“you”).

1. Authorized Use

License Scope: You may use the Services solely for your organization’s internal analytical purposes, consistent with your subscription.
Individual Access: Each account is licensed to a single individual. Credentials may not be shared or used by multiple users.

2. Prohibited Activities

Data Extraction and Copying:
- Do not copy, export, or scrape Data from the Services.
- Do not use automated tools or bots to collect or replicate Data.
Screenshot and Image Restrictions:
- Do not capture or distribute screenshots, screen recordings, or exports without prior written authorization.
- Do not include map or data imagery in internal presentations, shared tools, or documentation unless all viewers are licensed users.
Redistribution and Publication:
- Do not share or redistribute the Services or Data to third parties or affiliates.
- Do not publish or cite Forward Path Data without written approval.
Security and Access:
- Do not attempt to gain unauthorized access or bypass security controls.
- Do not test or interfere with Forward Path systems.
Misuse or Abuse:
- Do not use the Services to disrupt others or for illegal or competitive purposes.

3. Permitted Exceptions

Forward Path may grant broader usage rights via an alternate license agreement. Written permission is required for any screenshot, sharing, or research use outside the normal web interface.

4. Confidentiality

All Data and materials within the Services are confidential and proprietary to Forward Path. You must protect this information and disclose it only to authorized licensed users.

5. Monitoring and Enforcement

Forward Path may monitor use of the Services to ensure compliance, investigate violations, and suspend or terminate access for users or organizations that violate this Policy.

6. Reporting Violations

If you suspect misuse or unauthorized sharing, report it immediately to info@forward-path.net.

7. Policy Updates

Forward Path may update this Policy periodically. Continued use of the Services constitutes acceptance of any revised version.

Privacy

This is a privacy policy for the Forward Path website, subscription services, spectrum maps, data visualizations, and related materials (collectively, the “Services”).

1. Data we collect

Account Information: When you sign up for a subscription or purchase data services, we collect your name, email address, business information, and account credentials.
Payment Details: We do not store or process your credit card information directly. All payments are handled securely by our third-party subscription provider, Memberful (and their integrated payment processor Stripe).

2. How We Use Your Data

We only use your information to:
- Deliver your data services and manage your subscription.
- Send you essential account updates, receipts, or answer your support requests.

3. Data Sharing & Third Parties

We do not sell, rent, trade, or share your data with outside partners, advertisers, or vendors for marketing purposes. The only time your data interacts with an outside system is when it is necessary to run our website and services.

4. Cookies & Tracking

We use cookies and similar tracking technologies to keep our website functioning smoothly and to understand how people use it. Essential cookies keep you logged into your account and secure your subscription session. We use Google Analytics to monitor website traffic and see which pages are most popular. This tool collects anonymous data—like your browser type, device type, and which pages you visit—but it does not collect or store your real-world identity (like your name or email). You can opt out of this tracking by using a browser extension like the Google Analytics Opt-out Browser Add-on. Our website does not currently alter its behavior in response to automated 'Do Not Track' signals from your browser.
